Abstract

The development of digital technology has driven significant transformation in the broadcasting industry through the use of Internet Protocol Television (IPTV). However, the growth of illegal IPTV services that distribute content without authorization has generated serious challenges for the protection of Intellectual Property Rights (IPR), particularly copyright. In Indonesia, illegal IPTV practices constitute one of the contributing factors to the weak enforcement of IPR and have influenced Indonesia’s continued placement on the Priority Watch List (PWL) issued by the Office of the United States Trade Representative (USTR). This condition reflects ongoing tensions between national legal frameworks and international standards in addressing digital-based IPR violations. This study aims to analyze the legal basis and scope of regulations that qualify illegal IPTV services as violations of IPR within the Indonesian legal system, as well as to examine the construction of legal protection against illegal IPTV services from the perspective of the PWL. The research employs a normative juridical method, utilizing statutory and conceptual approaches. The analysis focuses on national legal provisions governing IPR protection, particularly copyright, as well as international legal instruments and non-binding policies, such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) and PWL reports issued by the USTR. The findings indicate that illegal IPTV services legally fulfill the elements of IPR infringement, as they involve unauthorized reproduction, distribution, and communication of copyrighted works to the public. Although Indonesia has established a national legal framework for IPR protection, the existing legal construction faces significant challenges in responding to the complexities of technology-based infringements and evolving international standards. Therefore, strengthening and updating legal policies that are more adaptive to digital technological developments is necessary to enhance the effectiveness of IPR protection and to improve Indonesia’s position within the international IPR protection regime.
