Design To Strengthen Bawaslu In The Integrated Election Law Enforcement System

Abstract

This article discusses the fragmentation of authority in election law enforcement in Indonesia, especially the position of Bawaslu in its relationship with the Police and the Prosecutor's Office through the Gakkumdu Center. Although Law Number 7 of 2017 has given authority to Bawaslu to supervise, receive reports, inspect, and decide on election administrative violations, the handling of election crimes still depends on inter-institutional understanding. This condition makes it difficult for many alleged violations to continue due to differences in evidentiary standards, time limitations, and lack of optimal institutional coordination. This research uses normative juridical methods with legislative, conceptual, and case approaches. The results of the study show that the strengthening of Bawaslu is not appropriate if it is directed to make it a superbody institution that takes over all investigation, prosecution, and judicial functions. More proportionate strengthening needs to be directed at increasing the binding power of administrative decisions, granting limited initial investigation authority, separating supervisory and adjudication functions, and reformulating the mechanism of the Gakkumdu Center to be more transparent and accountable. With this model, Bawaslu can play a more effective role in maintaining the integrity of elections without ignoring the principles of the rule of law, due process of law, and institutional impartiality.
